GENERAL BUSINESS TERMS AND CONDITIONS
1. General
The following general business terms and conditions apply to all contracts, orders and supplies. Any terms different from our own do not apply. All other agreements need to be confirmed by us in writing. Billard Corner/Steve Cliff reserves the right to change and / or complete these GBTs within a reasonable cancellation period. Orders taken before that change will be treated under the terms in effect at the time the order was taken.
2. Prices
All prices on this website are including 20% sales tax (10% for books) and excluding any shipping and insurance fees. We do not charge any handling fees, but all shipping and transport insurance costs are to be paid by the customer.
3. Offers
Our offers are not binding. Slight differences and / or technical changes from the pictured products and their discriptions are possible at all times. The old price list becomes void with the edition of a newer catalog.
4. Supply and payment
We have no minimum order amount. We reserve the right to make partial shipments whenever we find it reasonable to allow for a quicker transaction. We usually ship with regular mail but can ship by other methods if specified by the customer. All shipping fees will be charged in full to the customer and added to the order total. The shipping costs for billiard tables depends on the amount and shipping destination and have to be agreed upon separately.
We ship only on prepayment or COD (only available in Austria).
5. Delivery terms
In-stock products are usually shipped within 3 business days after the order is received by us. We do our best to ship all orders asap, the exact date of delivery for items not in stock has to be agreed upon separately. If the item(s) cannot be delivered within the fixed period for reasons not within our control (act of god, strike, other non-predictable circumstances), the date of delivery will be extended accordingly. If the delivery cannot be completed for reasons lying with our supplier(s), both parties have the right to cancel the contract when the agreed-upon date of delivery has been exceeded by more then 1 month. There is no compensation for late delivery whatsoever, unless the supply delay is based on deliberateness or negligence on our side.
6.Transport/shipping
We ship at the cost and risk of the buyer. We are not responsible or liable for any losses and/or damages during shipment. If not agreed-upon otherwise, we ship with what we think is cheapest. We do not insure our shipments to our customers unless other agreements have been made. We strongly recommend all our customers to immediately notify the freight/shipping company of any damages.
7. Retractions
The buyer has the right to retract from his order within 2 weeks. The retraction needs no further explanation but has to be expressed in written form and by returning the item(s) to us within 2 weeks, effective date of shipping. the buyer is obliged to return the items in question in case of retraction from the contract, either by mail or delivery to us. If this is not possible, the customer has to apply for pick-up and will be charged for all costs unless the item delivered is not in accordance with the order.
Retractions are not possible for any item(s) not included in our catalog and custom ordered and / or made for the buyer.
The buyer is held liable for any wear and/or damages to the returned items and the costs for repairs will be deducted from the total paid before we return the money. The items must be returned in their original packaging, otherwise the customer is responsible for any damages to returned items due to insufficient packaging.
8. Warranty
Billard Corner/Steve Cliff guarantees that all items are sold as advertised and are free of manufacturing defects at the time of shipment. We warrant all our products for 12 months from the date of delivery for manufacturing defects only (NOT warpage), unless suggested otherwise by the manufacturer. We do not accept responsibility for warpage or damage caused by misuse or mistreatment. The buyer must examine all items immediately upon arrival and inform us about any losses, damages or defects within 10 days of him noticing them. Warranties become void if the buyer fails to do so. The date of delivery has to be proven with a receipt. The warranty does not include normal wear of the product and automatically becomes void with any modification of the product by the buyer.
Billard Corner/Steve Cliff reserves the right to repair or replace the faulty product as long as the warranty applies. If we fail to repair or replace the item(s) in question within an appropriate amount of time, the buyer is entitled to a modification of the order or compensation.
The proof of guilt for any defects/flaws in our products lies with the buyer. All items remain the property of Billard Corner/Steve Cliff up to their complete payment.
9. Data security
We use your personal data exclusively for the handling of your inquiries or orders. The data necessary for the order processing is stored. We do not pass your data to other parties, unless this is necessary for the execution of your order.
10. Jurisdiction
Jurisdiction for all from the business relation resulting court complaints is the district court of Billard Corner/Steve Cliff. The present treaty is subject exclusively to the right of the Republic of Austria.
